Walmart is slated to pay $10 million to the estate of James McNair in a settlement reached with his family after one of the company’s trucks crashed into Tracy Morgan’s tour van, killing the comedian, reports DNAinfo New York.

The McNair family’s lawyer said the retail giant reached the settlement in order to avoid potential losses from litigation, citing legal documents filed in Westchester Surrogate’s Court.

Under the settlement, McNair’s two children, Jamel, 26, and Denita, 19, will split the payout after their lawyer, Daryl Zaslow, takes a nearly $3 million cut, according to court records.

The children had sued Wal-Mart after one of its trucks slammed into a limousine van carrying McNair, Morgan and other comedians on the New Jersey Turnpike on June 7, 2014.

New Jersey police charged the truck’s driver, Kevin Roper, with death by automobile and four other vehicle assault charges.

The accident occurred when Morgan, McNair, and their entourage left an event and were traveling on the New Jersey Turnpike. A Walmart tractor-trailer truck slammed into their Mercedes-Benz limo van.

Morgan sustained a traumatic brain injury from the impact and is still on the mend.
