A company named Urban Motive Sportswear is suing the sporting apparel giant because they claim Nike sold a Michael Jordan jacket called “Jordan LS Lottery Pick Jacket.” Urban Motive Sportswear claims they have been selling an energy drink called Lottery Pick since 2004. The company also alleges they registered the trademark in 2004 also.

UMS says their business was especially hit in Chicago because they heavily promoted their pro0duct in the city and Michael Jordan played most of his career there and people have confused the two different products. Urban Motive Sportswear even claims to have gifted Jordan’s sons some of their merchandise.

Nike is being sued for trademark infringement for unspecified damages. In court papers, Urban Motive Sportswear said the trademark infringement “damaged [them] in a manner that cannot be fully measured or compensated in economic terms and for which there is not adequate remedy at law.”

Jordan has not been named ion the lawsuit. Nike’s reps said they don’t comment on pending litigation.
