Dane County District Attorney Ismael Ozanne announced the fate of a Madison, Wisconsin police officer who is facing charges in the fatal shooting of an unarmed Black teen, Tony Robinson Jr. who was spectacularly gunned down in March, according to Reuters. Ozanne said the office used, “lawful use of deadly force.”

Tony Robinson Jr. was shot by a White officer on March 6 in Madison, sparking protests in the city at a time when the media spotlight was trained on the shooting deaths of other unarmed Blacks by White police officers in the country. The deaths have sparked ongoing protests around the nation, including most recently in Baltimore after the death of Freddie Gray.

In Wisconsin, Dane County District Attorney Ismael Ozanne said Sunday that he would announce Tuesday afternoon whether Officer Matt Kenny of the Madison Police Department will face charges in Robinson’s death. He did not set a time for that announcement or give any indication what decision he had reached.

Robinson’s family has hired lawyers to conduct their own investigation into the shooting and ordered an independent autopsy, according to the Wisconsin State Journal.

Police officials say that on the night of the shooting, Kenny was called to an apartment over reports that Robinson had been jumping in front of cars and assaulting people.

After hearing some commotion, Kenny forced his way into the apartment and was attacked by Robinson, according to police. Kenny responded by pulling out his gun and shooting Robinson, police officials say.

According to the Wisconsin State Journal, Robinson’s friends and family members have said he took hallucinogenic mushrooms and was behaving erratically the day he was killed. They reject the idea that Robinson was a threat to Kenny when he was shot, the newspaper reports.
